TRAVELER TERMS AND CONDITIONS
Please read these terms & conditions carefully before reserving your journey.
1) Validity
All travel offers subject to change by the supplier. Prices, dates, departures, itineraries, amenities, etc. are not guaranteed and subject to change. All published information is accurate to the best of our knowledge at the time of publishing, but please note that changes to our trips can and do occur. Many More Travels or ENV Travel (referred to herein as The Company) will make every effort to keep the client informed of any changes, but cannot be held liable for any alterations made to the published itineraries. .
2) Contract
To secure a booking for a trip, the Company requires a completed booking form together with a deposit of $1000 per person. Deposits may be different for custom and private trips and will be communicated prior to reserving. A reservation is accepted and becomes definite only from the date when the Company has confirmed acceptance by issuing the client with a confirmation email. It is at this point that a contract between the Company and the Client comes into existence. Before your reservation is confirmed and a contract comes into force, the Company reserves the right to decline any booking at their discretion. The contract is between the Company and the Client, being the person named on the booking form. The contract, including all matters arising from it, is subject to State of California law and the exclusive jurisdiction of the California courts. No employee, contractor or sub-contractor of the Company other than a director has the authority to vary or omit any of these terms or promise any discount or refund.
3) Payment For Your Tour
The balance of all monies due, including any surcharges applicable at that time, must be paid to the Company at the time provided for each trip before departure unless otherwise noted. In the case of non-payment of the balance by the due date the Company will treat the booking as canceled by the Client.
4) Terms & Conditions for Cancellation by the Client
Loss of monies paid applies to all canceled reservations. The date of trip cancellation is the date on which the written cancellation is received by the Company. The loss of monies paid is as follows, per person:
- Cancellation more than 121 days before departure-Full refund minus $250 processing fee.
- Cancellation after 120 days before departure – 100% of total booking cost already paid
- Cancellation policy for custom and private trips may differ from these terms and will be communicated prior to booking
No refunds will be made if you voluntarily leave a trip for any reason after the trip has begun. The same applies if you leave a trip or cannot fully participate in a trip due to injury or illness. Refunds will be at the discretion of the Company if you are involuntarily forced to leave a trip for any reason. No refunds will be made for any accommodation, transport, sightseeing, meals or services not utilized.
5) Cancellation by the Company
The Company reserves the right to cancel any trip if the trip does not attract the minimum number of clients required to make the trip financially viable. A proviso to this; the Company reserves the right to cancel a trip at any stage prior to the scheduled departure due to terrorism, natural disasters, political instability or other external events which make it nonviable for the Company to operate our planned schedule. In such a case, the Company will, at its own discretion, refund a portion of the trip price (less incurred costs), reschedule the tour, or offer an alternative tour. We require travel insurance or a signed waiver stating that the traveler understands our terms and conditions.
6) Booking Amendments
If you wish to change your booking in any way, you must contact us as soon as possible and we will accommodate your request to the best of our ability. Surcharges may apply.
7) Substitution of a Client
If any member of the party is prevented from traveling because of the death, injury or serious illness of the passenger, close relative or friend, redundancy or jury service, it may be possible to transfer the booking to another suitable person (acceptable to the Company) provided that written notice is given at least 15 days prior to departure. An administration fee of up to $150 may be imposed by the company to cover non-refundable costs
8) Surcharges
- Late booking/rush fee: Bookings made within 10 days of departure are subject to a $400 rush fee.
- Any additional nights, services or customization will be charged separately and may carry an additional surcharge
9) Insurance Terms & Conditions
Travel insurance is required for all clients on a trip organized by the Company. Travel insurance should cover adequate personal accident, medical, evacuation and repatriation expenses. The policy must also cover cancellation, curtailment, loss of effects and all other expenses that might arise as a result of loss, damage, injury, delay or inconvenience occurring to the client. If the client refuses trip insurance, a waiver must be signed releasing the Company of all financial, physical or any other loss sustained before, during or after the trip.
Clients, together with their personal property including baggage, are at all times solely at their own risk. Clients are wholly responsible for purchasing their own insurance either through the Company or their own insurance. When purchasing insurance, clients should ensure that there are no exclusion clauses limiting protection for the type of activities on their trip.
11) Responsibility
You acknowledge that participating in our trips requires a degree of flexibility, and understand that the route of a trip, accommodation and modes of transport are subject to change without prior notice due to local circumstances. Should the Company have to amend an itinerary for any reason, it may do so by varying or re-routing any trip. While traveling with the Company you agree to accept the authority of the leader and/or local operator at all times. You acknowledge that the Company contracts with a network of companies, government agencies and individuals to assist in the running of its trips. To the best of the Company’s knowledge, these third parties are qualified to perform the duties they are contracted to perform. However, the Company will not be held liable for any injury including death, damage, loss, delay or irregularity that may occur due to the behavior of these third parties. The Company will not accept responsibility or liability for any client who contravenes any law or regulation. No employee, contractor, sub-contractor, servant or agent of the Company has authority to vary these conditions. This agreement is governed by the laws of California.
12) Expectations
The Company does its utmost to ensure you a rewarding and enjoyable travel experience with us. In the case where we offer coaching and guiding, we also endeavor to provide you with the best possible learning experience. We understand that expectations vary greatly from person to person, however, and we cannot guarantee to meet all the expectations of the various people who attend our trips. By agreeing to these terms and conditions you accept that the Company will not be held accountable if our trips do not meet your particular expectations.
13) Dangers
Traveling with the Company may involve risks above and beyond those encountered on a more conventional holiday. Vacations involving cooking have inherent dangers that can result in injury. Likewise, you must also be prepared to accept responsibility for your own actions during our trips. Although our guides and coaches may provide you with advice and directions it is ultimately your responsibility to determine where your limits of capability and experience are and to avoid crossing these limits. We will not be held accountable for the choices and decisions you make during our trips.
By agreeing to these terms and conditions you accept the risks outlined in the above two paragraphs and fully assume the risks of traveling with the Company. You agree to release the Company from any liabilities connected to these risks.
14) Release of Liability, Waiver of Claims, Assumption of Risks and Indemnity Agreement (hereafter the “Release Agreement”)
By agreeing to this release agreement, you will waive certain legal rights, including the right to sue. Please read carefully!
To: The Company, and their directors, officers, employees, agents, independent contractors, subcontractors, representatives, sponsors, successors and assigns (all of whom are hereafter collectively referred to as “the RELEASEES”).
Assumption of Risk: I am aware that activities offered by the Company involve the risk of injury. I am aware that there is a risk of negligence by the Company and/or the trip operator, including the failure by the Company and/or the trip operator to safeguard or protect me from or warn me of the risks, dangers and hazards of cooking, eating, wine tasting, and other activities. I freely accept and fully assume all risks, dangers and hazards associated with participating in any trip and the possibility of loss, personal injury or death resulting therefrom.
In consideration of reserving a trip I hereby agree as follows:
1) To waive any and all claims that I have or may in the future have against the RELEASEES and to release the RELEASEES from any and all liability for any loss, damage, expense or injury, including death, that I may suffer or that my next-of-kin may suffer as a result of a trip due to any cause whatsoever, including negligence, breach of contract or breach of any statutory or other duty of care, on the part of the RELEASEES, and further including the failure on the part of the RELEASEES to safeguard or protect me from or warn me of the risks, dangers and hazards of participating in an the tour.
2) To hold harmless and indemnify the RELEASEES from any and all liability for any property damage or personal injury to any third party resulting from my participation in a tour;
3) This Release Agreement shall be effective and binding upon my heirs, next-of-kin, executors, administrators, assigns and representatives, in the event of my death or incapacity;
4) This Release Agreement and any rights, duties and obligations as between the parties to this Release Agreement shall be governed by and interpreted solely in accordance with the laws of California and no other jurisdiction; and
5) Any litigation involving the parties to this Release Agreement shall be brought solely within the state of California and shall be within the exclusive jurisdiction of the Courts of California.

Agreement between User and Many More Travels and ENVTravel.com
Welcome to Many More Travels and ENVTravel.com. The Many More Travels and ENVTRAVEL.com websites, comprised of various web pages operated Many More Travels ("Many More Travels") manymoretravels.com and ENVtravel.com are offered to you conditioned on your acceptance without modification of the terms, conditions, and notices contained herein (the "Terms"). Your use of manymoretravels.com and ENVTravel.com constitutes your agreement to all such Terms. Please read these terms carefully, and keep a copy of them for your reference. manymoretravels.com and ENVtravel.com are E-Commerce sites.
The purpose of these websites is to sell vacation travel and related products.
Privacy
Your use of manymoretravels.com and ENVtravel.com is subject to Many More Travels' Privacy Policy. Please review our Privacy Policy, which also governs the Site and informs users of our data collection practices.
Electronic Communications
Visiting manymoretravels.com and ENVtravel.com or sending emails to Many More Travels or ENV Travel constitutes electronic communications. You consent to receive electronic communications and you agree that all agreements, notices, disclosures and other communications that we provide to you electronically, via email and on the Site, satisfy any legal requirement that such communications be in writing.
Children Under Thirteen
Many More Travels does not knowingly collect, either online or offline, personal information from persons under the age of thirteen. If you are under 18, you may use manymoretravels.com and ENVtravel.com only with permission of a parent or guardian.
Cancellation/Refund Policy
All cancellations for any reserved travel or other products are subject to the terms and condition of the supplier. We strongly recommend travel insurance for any cancellations or losses incurred.

manymoretravels.com and ENVtravel.com may contain links to other websites ("Linked Sites"). The Linked Sites are not under the control of Many More Travels and Many More Travels is not responsible for the contents of any Linked Site, including without limitation any link contained in a Linked Site, or any changes or updates to a Linked Site. Many More Travels/ENV Travel is providing these links to you only as a convenience, and the inclusion of any link does not imply endorsement by Many More Travels of the site or any association with its operators.
Certain services made available via manymoretravels.com and ENVtravel.com are delivered by third party sites and organizations. By using any product, service or functionality originating from the manymoretravels.com domain, you hereby acknowledge and consent that Many More Travels may share such information and data with any third party with whom Many More Travels has a contractual relationship to provide the requested product, service or functionality on behalf of manymoretravels.com users and customers.

You agree to observe and abide by all copyright and other proprietary notices, legends or other restrictions contained in any such content and will not make any changes thereto.
You will not modify, publish, transmit, reverse engineer, participate in the transfer or sale, create derivative works, or in any way exploit any of the content, in whole or in part, found on the Site. Many More Travels content is not for resale. Your use of the Site does not entitle you to make any unauthorized use of any protected content, and in particular you will not delete or alter any proprietary rights or attribution notices in any content. You will use protected content solely for your personal use, and will make no other use of the content without the express written permission of Many More Travels and the copyright owner. You agree that you do not acquire any ownership rights in any protected content. Use of Communication Services
The Site may contain bulletin board services, chat areas, news groups, forums, communities, personal web pages, calendars, and/or other message or communication facilities designed to enable you to communicate with the public at large or with a group (collectively, "Communication Services"). You agree to use the Communication Services only to post, send and receive messages and material that are proper and related to the particular Communication Service.

Many More Travels has no obligation to monitor the Communication Services. However, Many More Travels reserves the right to review materials posted to a Communication Service and to remove any materials in its sole discretion. Many More Travels reserves the right to terminate your access to any or all of the Communication Services at any time without notice for any reason whatsoever.
Many More Travels reserves the right at all times to disclose any information as necessary to satisfy any applicable law, regulation, legal process or governmental request, or to edit, refuse to post or to remove any information or materials, in whole or in part, in Many More Travels' sole discretion.
Always use caution when giving out any personally identifying information about yourself or your children in any Communication Service. Many More Travels does not control or endorse the content, messages or information found in any Communication Service and, therefore, Many More Travels specifically disclaims any liability with regard to the Communication Services and any actions resulting from your participation in any Communication Service. Managers and hosts are not authorized Many More Travels spokespersons, and their views do not necessarily reflect those of Many More Travels.
Materials uploaded to a Communication Service may be subject to posted limitations on usage, reproduction and/or dissemination. You are responsible for adhering to such limitations if you upload the materials.

Third Party Accounts
You will be able to connect your Many More Travels account to third party accounts. By connecting your Many More Travels account to your third party account, you acknowledge and agree that you are consenting to the continuous release of information about you to others (in accordance with your privacy settings on those third party sites). If you do not want information about you to be shared in this manner, do not use this feature.
International Users
The Service is controlled, operated and administered by Many More Travels from our offices within the USA. If you access the Service from a location outside the USA, you are responsible for compliance with all local laws. You agree that you will not use the Many More Travels Content accessed through manymoretravels.com in any country or in any manner prohibited by any applicable laws, restrictions or regulations.
Indemnification
You agree to indemnify, defend and hold harmless Many More Travels, its officers, directors, employees, agents and third parties, for any losses, costs, liabilities and expenses (including reasonable attorney's fees) relating to or arising out of your use of or inability to use the Site or services, any user postings made by you, your violation of any terms of this Agreement or your violation of any rights of a third party, or your violation of any applicable laws, rules or regulations. Many More Travels reserves the right, at its own cost, to assume the exclusive defense and control of any matter otherwise subject to indemnification by you, in which event you will fully cooperate with Many More Travels in asserting any available defenses.
Arbitration
In the event the parties are not able to resolve any dispute between them arising out of or concerning these Terms and Conditions, or any provisions hereof, whether in contract, tort, or otherwise at law or in equity for damages or any other relief, then such dispute shall be resolved only by final and binding arbitration pursuant to the Federal Arbitration Act, conducted by a single neutral arbitrator and administered by the American Arbitration Association, or a similar arbitration service selected by the parties, in a location mutually agreed upon by the parties. The arbitrator's award shall be final, and judgment may be entered upon it in any court having jurisdiction. In the event that any legal or equitable action, proceeding or arbitration arises out of or concerns these
Terms and Conditions, the prevailing party shall be entitled to recover its costs and reasonable attorney's fees. The parties agree to arbitrate all disputes and claims in regards to these Terms and Conditions or any disputes arising as a result of these Terms and Conditions, whether directly or indirectly, including Tort claims that are a result of these Terms and Conditions. The parties agree that the Federal Arbitration Act governs the interpretation and enforcement of this provision. The entire dispute, including the scope and enforce-ability of this arbitration provision shall be determined by the Arbitrator. This arbitration provision shall survive the termination of these Terms and Conditions.
Class Action Waiver
Any arbitration under these Terms and Conditions will take place on an individual basis; class arbitration and class/representative/collective actions are not permitted. THE PARTIES AGREE THAT A PARTY MAY BRING CLAIMS AGAINST THE OTHER ONLY IN EACH INDIVIDUAL CAPACITY, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PUTATIVE CLASS, COLLECTIVE AND/ OR REPRESENTATIVE PROCEEDING, SUCH AS IN THE FORM OF A PRIVATE ATTORNEY GENERAL ACTION AGAINST THE OTHER. Further, unless both you and Many More Travels agree otherwise, the arbitrator may not consolidate more than one person's claims, and may not otherwise preside over any form of a representative or class proceeding.

THE INFORMATION, SOFTWARE, PRODUCTS, AND SERVICES INCLUDED IN OR AVAILABLE THROUGH THE SITE MAY INCLUDE INACCURACIES OR TYPOGRAPHICAL ERRORS. CHANGES ARE PERIODICALLY ADDED TO THE INFORMATION HEREIN. MANY MORE TRAVELS AND/OR ITS SUPPLIERS MAY MAKE IMPROVEMENTS AND/OR CHANGES IN THE SITE AT ANY TIME.
MANY MORE TRAVELS AND/OR ITS SUPPLIERS MAKE NO REPRESENTATIONS ABOUT THE SUITABILITY, RELIABILITY, AVAILABILITY, TIMELINESS, AND ACCURACY OF THE INFORMATION, SOFTWARE, PRODUCTS, SERVICES AND RELATED GRAPHICS CONTAINED ON THE SITE FOR ANY PURPOSE. TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, ALL SUCH INFORMATION, SOFTWARE, PRODUCTS, SERVICES AND RELATED GRAPHICS ARE PROVIDED "AS IS" WITHOUT WARRANTY OR CONDITION OF ANY KIND. MANY MORE TRAVELS AND/OR ITS SUPPLIERS HEREBY DISCLAIM ALL WARRANTIES AND CONDITIONS WITH REGARD TO THIS INFORMATION, SOFTWARE, PRODUCTS, SERVICES AND RELATED GRAPHICS, INCLUDING ALL IMPLIED WARRANTIES OR CONDITIONS OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE AND NON-INFRINGEMENT.
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL MANY MORE TRAVELS AND/OR ITS SUPPLIERS BE LIABLE FOR ANY DIRECT, INDIRECT, PUNITIVE, INCIDENTAL, SPECIAL, CONSEQUENTIAL DAMAGES OR ANY DAMAGES WHATSOEVER INCLUDING, WITHOUT LIMITATION, DAMAGES FOR LOSS OF USE, DATA OR PROFITS, ARISING OUT OF OR IN ANY WAY CONNECTED WITH THE USE OR PERFORMANCE OF THE SITE, WITH THE DELAY OR INABILITY TO USE THE SITE OR RELATED SERVICES, THE PROVISION OF OR FAILURE TO PROVIDE SERVICES, OR FOR ANY INFORMATION, SOFTWARE, PRODUCTS, SERVICES AND RELATED GRAPHICS OBTAINED THROUGH THE SITE, OR OTHERWISE ARISING OUT OF THE USE OF THE SITE, WHETHER BASED ON CONTRACT, TORT, NEGLIGENCE, STRICT LIABILITY OR OTHERWISE, EVEN IF MANY MORE TRAVELS OR ANY OF ITS SUPPLIERS HAS BEEN ADVISED OF THE POSSIBILITY OF DAMAGES. BECAUSE SOME STATES/JURISDICTIONS DO NOT ALLOW THE EXCLUSION OR LIMITATION OF LIABILITY FOR CONSEQUENTIAL OR INCIDENTAL DAMAGES, THE ABOVE LIMITATION MAY NOT APPLY TO YOU. IF YOU ARE DISSATISFIED WITH ANY PORTION OF THE SITE, OR WITH ANY OF THESE TERMS OF USE, YOUR SOLE AND EXCLUSIVE REMEDY IS TO DISCONTINUE USING THE SITE.
Termination/Access Restriction
Many More Travels reserves the right, in its sole discretion, to terminate your access to the Site and the related services or any portion thereof at any time, without notice. To the maximum extent permitted by law, this agreement is governed by the laws of the State of California and you hereby consent to the exclusive jurisdiction and venue of courts in California in all disputes arising out of or relating to the use of the Site. Use of the Site is unauthorized in any jurisdiction that does not give effect to all provisions of these Terms, including, without limitation, this section.
You agree that no joint venture, partnership, employment, or agency relationship exists between
you and Many More Travels as a result of this agreement or use of the Site. Many More Travels' performance of this agreement is subject to existing laws and legal process, and nothing contained in this agreement is in derogation of Many More Travels's right to comply with governmental, court and law enforcement requests or requirements relating to your use of the Site or information provided to or gathered by Many More Travels with respect to such use. If any part of this agreement is determined to be invalid or unenforceable pursuant to applicable law including, but not limited to, the warranty disclaimers and liability limitations set forth above, then the invalid or unenforceable provision will be deemed superseded by a valid, enforceable provision that most closely matches the intent of the original provision and the remainder of the agreement shall continue in effect.
Unless otherwise specified herein, this agreement constitutes the entire agreement between the user and Many More Travels with respect to the Site and it supersedes all prior or contemporaneous communications and proposals, whether electronic, oral or written, between the user and Many More Travels with respect to the Site. A printed version of this agreement and of any notice given in electronic form shall be admissible in judicial or administrative proceedings based upon or relating to this agreement to the same extent and subject to the same conditions as other business documents and records originally generated and maintained in printed form. It is the express wish to the parties that this agreement and all related documents be written in English.
Changes to Terms
Many More Travels reserves the right, in its sole discretion, to change the Terms under which manymoretravels.com is offered. The most current version of the Terms will supersede all previous versions. Many More Travels encourages you to periodically review the Terms to stay informed of our updates.
